Judge rules New York City bar can refuse service to Trump supporter wearing MAGA hat<\/span><\/strong><\/h2>\n

A Manhattan judge ruled Wednesday that kicking a Trump supporter out of a bar does not violate the law \u2013 because the law does not protect against political discrimination.<\/span><\/p>\n

Greg Piatek of Philadelphia claims he was refused service and then eventually removed from a New York City bar in January 2017 for wearing a \u201cMake American Great Again\u201d hat, in a lawsuit against the establishment.<\/span><\/p>\n

\u201cAnyone who supports Trump \u2014 or believes in what you believe \u2014 is not welcome here! And you need to leave right now because we won\u2019t serve you!\u201d Piatek claims the staff of The Happiest Hour told him.<\/span><\/p>\n

Piatek claimed the incident \u201coffended his sense of being an American,\u201d the New York Post reported.<\/span><\/p>\n

The lawyer representing The Happiest Hour, Elizabeth Conway, argued that he was not discriminated against because only religious \u2013 not political \u2013 beliefs are protected under state and city discrimination law.<\/span><\/p>\n

\u201cSupporting Trump is not a religion,\u201d Conway argued.<\/span><\/p>\n

Piatek\u2019s attorney Paul Liggieri responded in court, \u201cThe purpose of the hat is that he wore it because he was visiting the 9\/11 Memorial.\u201d<\/span><\/p>\n

\u201cHe was paying spiritual tribute to the victims of 9\/11. The Make American Great Again hat was part of his spiritual belief,\u201d Liggieri claimed. “Rather than remove his hat, instead he held true to his spiritual belief and was forced from the bar,\u201d Liggieri told Justice David Cohen, the New York Post reported.<\/span><\/p>\n

The judge pressed Liggieri on the spiritual nature of his client’s belief, saying the bar staff would not be aware of Piatek\u2019s specific religious philosophies.<\/span><\/p>\n

\u201cHow many members are in this spiritual program that your client is engaged in?\u201d the judge asked.<\/span><\/p>\n

\u201cYour honor, we don\u2019t allege the amount of individuals,\u201d Liggieri said.<\/span><\/p>\n

\u201cSo, it\u2019s a creed of one?\u201d the judge asked.<\/span><\/p>\n

\u201cYes, your honor,\u201d Liggieri replied, the New York Post reported.<\/span><\/p>\n

The judge eventually made a ruling on the matter, saying the incident amount to nothing more than a \u201cpetty slight,\u201d the New York Post reported.<\/span><\/p>\n

\u201cPlaintiff does not state any faith-based principle to which the hat relates,\u201d Judge Cohen said. \u201cHere the claim that plaintiff was not served and eventually escorted out of the bar because of his perceived support for President Trump is not outrageous conduct.\u201d<\/span><\/p>\n

Piatek was suing for unspecified emotional damage and will review with Liggieri to determine whether or not to appeal the verdict.<\/span><\/p>\n

The Happiest Hour denied that Piatek had been removed in the first place, stating Piatek \u201cwas sufficiently pleased with his service at the bar [and] that he added\u201d a $36 tip onto the $186 tab, according to the New York Post. The bar owners suggest Piatek\u2019s lawsuit was a \u201cpublicity stunt.\u201d<\/span><\/p>\n
