New York Police Officers Facing Rape Charges Quit the Force<\/span><\/strong><\/span><\/h2>\n

New York Police Officers Facing Rape Charges Quit the Force:- The two New York City officers charged last week with raping an 18-year-old woman after a drug stop in September quit the Police Department on Monday, three days before they were scheduled to face an internal trial.<\/span><\/p>\n

The officers, Edward Martins and Richard Hall, were slated to appear on Thursday morning before a departmental judge, even though the criminal case against them has only just begun.<\/span><\/p>\n

Typically, the department waits until after criminal proceedings are complete so that the internal inquiry, in which officers can be compelled to answer questions, does not affect the criminal case, in which officers, like any other person, have the right to remain silent. But in this case, the department chose to act ahead of prosecutors.<\/span><\/p>\n

In a brief statement issued on Monday, the Police Department said that Mr. Martins, 37, and Mr. Hall, 33, who were demoted from detectives after their indictment, \u201cappeared on their own at Police Headquarters today and quit their employment with the N.Y.P.D.\u201d The statement gave no reason for the resignations. Stephen P. Davis, the department\u2019s chief spokesman, said that the officers would get back \u201cwhatever money they put into their pension,\u201d but would not receive full pensions.<\/span><\/p>\n

\u201cWhen a member of the N.Y.P.D. is indicted on serious charges like these, it tarnishes all of the admirable things accomplished by other, good officers every day in neighborhoods across New York City,\u201d the police commissioner, James P. O\u2019Neill, said in a separate statement. Mr. O\u2019Neill added that had the charges against the officers been upheld at the internal trial, he \u201cwould have fired them immediately.\u201d<\/span><\/p>\n

The departmental hearings are meant to determine what, if any, internal disciplinary actions \u2014 up to being fired \u2014 should be meted out against officers accused of misconduct. The charges in this case were not directly related to the encounter with the young woman, but stemmed instead from the officers\u2019 refusal to answer questions about the incident from investigators with the Police Department\u2019s Internal Affairs Bureau.<\/span><\/p>\n

Mark A. Bederow, a lawyer for Mr. Martins, said it was unfair that investigators had sought to interview the officers after criminal charges had been filed, possibly exposing them to self-incrimination. \u201cThey were compelled to speak about the incident at a time when the N.Y.P.D. already knew that they been indicted by a grand jury and after a series of leaks attributed to police sources,\u201d Mr. Bederow said. \u201cWe are focusing all of our effort and energy now on the Brooklyn indictment and on demonstrating that the allegations against Detective Martins are false.\u201d<\/span><\/p>\n

John Arlia, Mr. Hall\u2019s lawyer, did not respond to phone calls seeking comment.<\/span><\/p>\n

The accusations against Mr. Hall, who joined the Police Department in July 2010, and Mr. Martins, who joined in July 2006, are some of the most explosive to have been leveled against police officers in New York City in decades. Prosecutors from the Brooklyn district attorney\u2019s office assert that the two officers took turns sexually assaulting the 18-year-old woman after they had pulled her car over on Sept. 15 and put her \u2014 in handcuffs \u2014 into their police van.<\/span><\/p>\n

Prosecutors said that the officers had been working on the night of the encounter with their antidrug unit, Brooklyn South Narcotics, in Coney Island, but broke away from their team and stopped the woman\u2019s car in Calvert Vaux Park in the nearby Gravesend neighborhood. After she admitted there was a small amount of marijuana and few a pills of Klonopin, an anti-anxiety drug, in the car, the officers told her that she was being arrested, prosecutors said, and ordered her two male friends, who were passengers in the car, not to follow the police van.<\/span><\/p>\n

As the van drove off, prosecutors said, Mr. Martins sat down next to the woman and asked her what she wanted to do to get out of the situation. Then, the prosecutors said, he forced the woman to perform oral sex on him and raped her as Mr. Hall watched through the rearview mirror.<\/span><\/p>\n

Once the van had reached Bay Ridge, about four miles from where the antidrug team had been working, Mr. Martins took the wheel and Mr. Hall climbed in the back and forced the young woman to perform oral sex on him as well, prosecutors said. After the assault, they added, the officers drove back to Coney Island and dropped the woman off about five blocks from their station house, warning to her keep her mouth shut.<\/span><\/p>\n
