Weiner, the disgraced former congressman who has been under scrutiny by federal prosecutors in Manhattan over allegations that he exchanged illicit text messages with a 15-year-old girl.<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: Arial, Helvetica, sans-serif; color: #000000;\">But the inquiry itself \u2014 because of its timing and unusual public disclosure \u2014 took on greater implications. Less than two weeks before Election Day, the F.B.I. director, James B. Comey, disclosed the inquiry in a letter to Congress, saying that the emails, which the F.B.I. had not yet examined, \u201cappear to be pertinent.\u201d<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: Arial, Helvetica, sans-serif; color: #000000;\">Mr. Comey later told Congress that the inquiry did not change the bureau\u2019s conclusion that Mrs. Clinton should face no charges over her handling of classified information.<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: Arial, Helvetica, sans-serif; color: #000000;\">Mr. Comey\u2019s handling of the inquiry came under broad criticism. One harsh critic, E. Randol Schoenberg, a lawyer who has written that Mr. Comey\u2019s letter cost Mrs. Clinton the presidency, requested the search warrant materials. He argued in a court filing that with the email inquiry over, access to materials \u201cthat provided the basis for the investigation are of the utmost public importance.\u201d<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: Arial, Helvetica, sans-serif; color: #000000;\">The judge, P. Kevin Castel of Federal District Court, ordered the Justice Department to file with him under seal, by 5 p.m. Thursday, a copy of any search warrant application and related documents (he said he was not asking the government to confirm in open court that they even existed). He said the government should also propose redactions of any materials that, for example, could compromise investigations or people\u2019s reputations if made public.<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: Arial, Helvetica, sans-serif; color: #000000;\">Mr. Schoenberg, who did not attend the hearing, said later by phone from Los Angeles that his impression, after speaking with his lawyer, David B. Rankin, was that the judge \u201cseemed very favorably inclined toward our petition to unseal the Clinton search warrant.\u201d<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: Arial, Helvetica, sans-serif; color: #000000;\">Jennie L. Kneedler, a Justice Department lawyer, told the judge that the government objected to the unsealing request. Mr. Schoenberg has not shown that the \u201cneed for secrecy\u201d for any such document \u201chas abated,\u201d she said.<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: Arial, Helvetica, sans-serif; color: #000000;\">In court, neither the judge nor the parties mentioned Ms. Abedin or Mr. Weiner by name. But Judge Castel cited a statement by Mr. Comey, in the Oct. 28 letter, that said the emails had been discovered in an \u201cunrelated\u201d case. Judge Castel asked Mr. Schoenberg\u2019s lawyer, Mr. Rankin, whether his client was seeking information about that case, and Mr. Rankin said no.<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: Arial, Helvetica, sans-serif; color: #000000;\">\u201cSo, it would be quite appropriate to redact that,\u201d Judge Castel said. It may also be appropriate, he added, to redact information about \u201cany subject of the investigation of Secretary Clinton who has not been identified by Director Comey, but that I have an open mind on. I don\u2019t have a view on that.\u201d<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: Arial, Helvetica, sans-serif; color: #000000;\">But the judge said that in the case of Mrs. Clinton, \u201cshe has been identified by name, and the letter of Director Comey seems to indicate that investigation is now completed.\u201d<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: Arial, Helvetica, sans-serif; color: #000000;\">Ms. Kneedler, the Justice Department lawyer, said that the government welcomed the opportunity to make the sealed submission, which the plaintiff will not see.
